Terms of Use

1. Acceptance
By creating an account or using OptoGuide™, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the platform.
OptoGuide™ is operated by [LEGAL ENTITY NAME] (ABN [ABN]), [BUSINESS ADDRESS], Australia (“we”, “us”, “our”). In these terms, “you” means the individual practitioner holding the account.
2. What OptoGuide™ is
OptoGuide™ is a deterministic clinical workflow tool designed to support Australian optometrists during consultations. It provides structured decision pathways, drug and therapeutic references, referral generation tools, and client-side prescription PDF preparation tools.
OptoGuide™ is not an AI diagnostic system. It does not generate probabilistic diagnoses. All clinical logic is rule-based and auditable.
3. Clinical use and responsibility
OptoGuide™ is a clinical decision-support tool intended for use by qualified health professionals. It provides structured workflows, reference information, and general guidance based on published clinical standards.
OptoGuide™ does not provide personalised medical advice, does not establish a diagnosis, and does not determine treatment for any individual patient.
You acknowledge and agree that:
- all clinical decisions are made solely by you as the treating practitioner
- you must independently assess each patient and verify all information before acting
- you are solely responsible for any prescribing, referral, or management decisions
- OptoGuide™ does not verify, confer, or extend prescribing authority, therapeutic endorsement, or scope of practice
OptoGuide™ content may not reflect all possible clinical scenarios and may be incomplete, outdated, or subject to change. You must always rely on your professional judgment and current authoritative sources, including the PBS, TGA, and current clinical guidelines.
3A. Intended users
OptoGuide™ is intended for use by qualified optometrists, optometry students under supervision, and other registered health professionals. Certain features, including live prescribing and referral execution, require you to hold and declare the relevant registration, prescriber number and therapeutic endorsement.
It is not intended for use by patients or the general public. Any use outside of a professional clinical context is at the user's own risk.
4. Acceptable use
You agree to use OptoGuide™ only for lawful purposes and in accordance with these terms. You must not:
- Use OptoGuide™ to provide clinical opinions to patients without independent clinical assessment
- Share your account credentials with others. Accounts are for a single named practitioner, and we monitor for concurrent use across devices and locations
- Attempt to reverse engineer, scrape, or extract content from the platform
- Use the platform in any way that could harm patients or bring the profession into disrepute
- Enter patient-identifiable information anywhere except in the local prescription or referral generators, where it is never transmitted to our servers
- Enter patient-identifying details into Case Records, support messages, or any free-text field that is saved to our servers
5. Account and access
You are responsible for maintaining the security of your account credentials and for the accuracy of the professional details on your profile. You must notify us promptly if you believe your account has been compromised. We reserve the right to suspend or terminate accounts that violate these terms.
6. Free trial
Every new account starts with a 14-day full-access trial. No payment method is required to start the trial, and it does not convert into a paid subscription automatically. When the trial period ends, your account simply reverts to the free tier, and you will not be charged unless you separately choose to subscribe.
During an active trial you may use prescribing and referral execution features, provided you meet the clinical requirements in clause 3A. Once a trial lapses, those features are blocked while learning and reference access continues. Accounts created through a colleague's referral invitation receive a 28-day trial on the same terms. Trials are limited to one per person.
7. Subscription and billing
OptoGuide™ offers a free tier and a paid individual subscription. Current pricing is shown on the Pricing page. Payments are processed by Stripe. By subscribing, you agree to the applicable plan pricing at the time of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
You may cancel at any time from the billing portal in your profile. Cancellation takes effect at the end of your current billing period, and access continues until then. Pricing is subject to change; registered users will be notified by email of material changes before they take effect, and any change applies from your next renewal, never mid-period.
8. Refunds and your consumer rights
Because every account can trial the full product free of charge before paying, we do not offer refunds for change of mind, for partially used billing periods, or for periods during which you did not use the service. Cancelling stops future renewals; it does not refund the current period.
This does not limit your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded, including that they will be provided with due care and skill and be fit for the purpose we describe. If we fail to meet a consumer guarantee, you are entitled to a remedy, which for a major failure includes cancelling the service and obtaining a refund of the unused portion. If you believe something has gone wrong, contact us and we will work with you in good faith.
9. Referral program
If we make a referral program available, the following terms apply.
- Your personal invitation link gives a new colleague a 28-day full-access trial instead of the standard 14 days.
- You earn a reward only when a person you referred converts to a paid subscription for the first time. No reward is earned at signup, or if they never subscribe.
- The reward is one month of the standard monthly plan price, applied as an account credit to your billing account, and is applied against your next invoice. If you do not have a paid subscription at the time, we instead extend your access by 30 days.
- The credit is a fixed amount equal to one month at the standard monthly rate, regardless of the plan or billing interval you are on. Annual subscribers receive that same fixed credit, not one twelfth of an annual fee.
- One reward per referred person. Rewards have no cash value, are not transferable, and cannot be redeemed for cash or refunded.
- Self-referral, duplicate or fictitious accounts, and any attempt to manipulate the program will forfeit rewards and may result in account suspension.
- We may change or end the program at any time. Rewards already credited to your account will be honoured.
10. Intellectual property
The OptoGuide™ software, interface, design, and the clinical pathways, workflows, summaries and illustrations we author are our intellectual property or are used under licence. Subject to these terms, we grant you a personal, non-exclusive, non-transferable licence to use OptoGuide™ for your own clinical practice for as long as your account is active.
You may use, print and share the documents you generate: prescriptions, referral letters, patient handouts and CPD records, in the ordinary course of your practice. You may not otherwise reproduce, redistribute, resell or create derivative works from OptoGuide™ content, or use it to build a competing product, without our written permission.
Third-party material. OptoGuide™ reproduces or summarises material owned by others, including Medicare Benefits Schedule and Pharmaceutical Benefits Scheme information published by the Commonwealth of Australia, Austroads assessing-fitness-to-drive standards, published clinical guidelines, and pharmaceutical brand names. That material remains the property of its respective owners, is used for reference purposes, and is not claimed by us. All third-party trade marks are the property of their respective owners. Our attribution notices are published at optoguide.com.au/attributions.
Content you create. You retain ownership of the case records, notes, CPD entries and other content you enter. You grant us only the limited licence needed to store, display and back it up so we can provide the service to you.
11. Limitation of liability
OptoGuide™ is provided as a clinical decision-support tool only. It does not replace professional judgment or clinical responsibility.
To the maximum extent permitted by law, and subject to clause 8:
- you assume all risk associated with the use of OptoGuide™
- we are not liable for any loss, clinical outcome, patient harm, or professional consequence arising from use of the platform
- we make no warranties regarding the accuracy, completeness, or suitability of the content
- we are not liable for indirect or consequential loss, or for loss of profits, goodwill or data
- where our liability cannot be excluded but can be limited, it is limited to resupplying the service or paying the cost of resupply
You agree that responsibility for all clinical decisions, including prescribing and referral, remains solely with you.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law.
12. Changes to these terms
We may update these terms from time to time. Material changes will be communicated to registered users by email before they take effect, and we will ask you to accept the revised terms when you next sign in. Continued use of OptoGuide™ after an update constitutes acceptance of the revised terms.
13. Governing law
These terms are governed by the laws of [STATE], Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of that state, and courts entitled to hear appeals from them.
